4. Takedown Notice Requirements

What your DMCA notice must include

To be valid under the DMCA (17 U.S.C. ยง 512), your takedown notice must include all of the following:

  1. Your Identification: Your full legal name, address, telephone number, and email address as the copyright owner or authorized agent
  2. Description of Copyrighted Work: A clear description of the copyrighted work you claim has been infringed, including the URL of the original work if available
  3. Location of Infringing Content: The specific URL(s) on CodexGuruu.com where the allegedly infringing content is located
  4. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  5. Accuracy Statement: A statement, under penalty of perjury, that the information in your notice is accurate

5. Our Takedown Process

What happens after we receive your notice

Upon receiving a valid DMCA takedown notice, CodexGuruu will follow this process:

  1. Acknowledgment (24-48 hours): We will send an acknowledgment email confirming receipt of your DMCA notice
  2. Review (2-5 business days): Our team will review the notice to verify it contains all required elements and assess the claim
  3. Action: If the notice is valid, we will promptly remove or disable access to the allegedly infringing content
  4. Notification: We will notify the content provider/poster that their content has been removed due to a DMCA notice
  5. Counter-Notice Period: The content provider has the opportunity to file a counter-notice (see Section 6)
  6. Resolution: We will inform you of the outcome and any further steps required

Response Time: We aim to respond to all valid DMCA notices within 2-5 business days. For urgent matters, please indicate “URGENT DMCA” in your email subject line.

6. Counter-Notice Procedure

If your content was wrongly removed

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our designated agent.

Counter-Notice Must Include:

  1. Your Identification: Your full name, address, telephone number, and email address
  2. Identification of Removed Content: Description of the material that was removed and its location before removal
  3. Good Faith Statement: A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located
  5. Signature: Your physical or electronic signature

What Happens After Counter-Notice

  • We will forward your counter-notice to the original complainant
  • The complainant has 10-14 business days to seek a court order
  • If no court order is obtained, we may restore the removed content

7. Repeat Infringer Policy

Our policy on repeat copyright violations

CodexGuruu has a zero-tolerance policy for repeat copyright infringers. In appropriate circumstances, we will:

  • Terminate the accounts of users who repeatedly infringe copyrights
  • Ban IP addresses associated with repeated infringement
  • Report repeat infringers to relevant authorities
  • Take legal action against persistent infringers

We track all DMCA notices received and maintain records of repeat infringement activity. This policy is in accordance with Section 512(i) of the DMCA.

8. False DMCA Claims

Legal consequences of false notices

Please be aware that under 17 U.S.C. ยง 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages including:

  • Costs and attorney’s fees incurred by the alleged infringer
  • Costs and attorney’s fees incurred by the service provider
  • Any other damages resulting from the misrepresentation

We take false DMCA notices very seriously. If we receive a DMCA notice we believe to be abusive, fraudulent, or submitted in bad faith, we reserve the right to:

  • Reject the notice without action
  • Report the submitter to relevant authorities
  • Pursue appropriate legal remedies
